Handling of gas and signal weapons according to the law In Germany, legal blank-firing weapons can be recognized by the seal of the Physikalisch-Technische Bundesanstalt (PTB) and the caliber, which is stamped on the slide. Blank-firing weapons without a PTB seal are considered firearms and thus require a permit; their illegal possession is punishable by law. Carrying blank-firing weapons outside of one's own home, business premises, or secured property has required a small firearms permit since April 1, 2003. The mere possession, acquisition, and transport of these weapons is permitted from the age of 18. Shooting with a blank-firing pistol remains permissible only on secured property, even with the small firearms permit, provided that no noise disturbance is caused. PTB pistols and revolvers fall under German firearms law. Generally, shooting is always subject to approval. However, exceptions are: Exceptions according to § 12 Abs. 4 WaffG-neu: a) Self-defense, emergency b) with signal weapons during emergency and rescue exercises c) with firearms that can only fire cartridge ammunition (1) by participants in theater performances and similar presentations, (2) to scare away birds in agricultural operations d) on secured property - with the permission of the holder of the house rights - with firearms that can only fire cartridge ammunition, e) with blank-firing or signal weapons to give start or finish signals on behalf of the organizers at sporting events when optical or acoustic signaling is required. The widely practiced shooting on New Year's Eve is no different from other situations. It is only allowed on one's own secured property, or on another property with the permission of the holder of the house rights (see above). The often used pyrotechnic ammunition may not leave the property. However, transport to the shooting location is permitted without a permit, provided the weapon is transported in a non-ready-to-fire condition and securely locked. Umgang mit Gas- und Signalwaffen laut Gesetz In Deutschland können legale Schreckschusswaffen am Siegel der Physikalisch-Technischen Bundesanstalt (PTB) und dem Kaliber, welches auf dem Verschluss eingeprägt ist, erkannt werden. Schreckschusswaffen ohne PTB-Siegel gelten als scharfe Schusswaffen und sind somit erlaubnispflichtig; ihr unerlaubter Besitz ist strafbar. Das Führen von Schreckschusswaffen erfordert außerhalb der eigenen Wohnung, Geschäftsräumen oder des befriedeten Besitztums seit dem 1. April 2003 einen Kleinen Waffenschein. Der reine Besitz, Erwerb und Transport dieser Waffen ist jedoch ab dem Vollenden des 18. Lebensjahres gestattet. Das Schießen mit einer Schreckschusspistole bleibt trotz eventuellem Vorhandensein des Kleinen Waffenscheins nur auf dem befriedeten Besitztum zulässig, wenn dabei keine Lärmbelästigung erzeugt wird. PTB-Pistolen und -Revolver fallen unter das deutsche Waffengesetz. Generell ist das Schießen immer genehmigungspflichtig. Ausnahmen sind jedoch: Ausnahmen gemäß § 12 Abs. 4 WaffG-neu: a) Notwehr, Notstand b) mit Signalwaffen bei Not- und Rettungsübungen c) mit Schußwaffen, aus denen nur Kartuschenmunition verschossen werden kann (1) durch Mitwirkende an Theateraufführungen und diesen gleich zu achtende Vorführungen, (2) zum Vertreiben von Vögeln in landwirtschaftlichen Betrieben d) im befriedeten Besitztum - mit Genehmigung des Inhabers des Hausrechtes - mit Schußwaffen, aus denen nur Kartuschenmunition verschossen werden kann, e) mit Schreckschuss- oder Signalwaffen zur Abgabe von Start- oder Beendigungszeichen im Auftrag der Veranstalter bei Sportveranstaltungen, wenn optische oder akustische Signalgebung erforderlich ist. Das weit verbreitete Schießen zu Silvester unterscheidet sich nicht von anderen Situationen. Es ist nur auf dem eigenen, befriedeten Besitztum erlaubt, oder auf einem anderen Besitztum, mit Genehmigung des Inhabers des Hausrechtes (s.o.). Die oft eingesetzte pyrotechnische Munition darf das Besitztum jedoch nicht verlassen. Der Transport zum Schießort ist jedoch erlaubnisfrei, sofern die Waffe in nicht-schießbereitem Zustand verschlossen transportiert wird.
