Il problema della privacy in ambito di videosorveglianza è all’ordine del giorno, non sono esenti da queste problematiche le fototrappole.
Vediamo allora come utilizzare questi strumenti cercando di non incorrere in violazioni di norme vigenti.
Innanzi tutto se le fototrappole vengono utilizzate in ambito faunistico a scopo di ricerca e quindi si intende divulgare le immagini, se il luogo è soggetto comunque al passaggio e/o alla presenza di persone, è necessario informare le stesse che si sta per accedere ad un area videosorvegliata. Per far ciò è sufficiente utilizzare i cartelli preparati ad hoc dal garante della privacy, in cui si fa riferimento alla motivazione che giustifica le riprese e si indica un responsabile del trattamento dei dati registrati.
Se le fototrappole vengono utilizzate per scopi di sicurezza e protezione di beni, e l’installazione avviene su un’area privata, non è obbligatorio segnalare la presenza di strumenti di videoripresa, a patto di avere l’autorizzazione del proprietario dell’area.
Nel caso in cui l’installazione avvenga in un’area pubblica o privata aperta al pubblico, è necessario esporre le tabelle che indicano “area videosorvegliata” prima dell’accesso alla zona ripresa.
In tutti i casi è bene che i dati registrati siano protetti essendo il proprietario dell’ “impianto” di videosorveglianza anche il responsabile in materia di protezione dei dati e (se non quando specificato il contrario) l’unico autorizzato al trattamento delle immagini. Con le fototrappole è possibile far questo impostando una “password” che impedisca a chiunque se non autorizzato di cambiare la configurazione dell’apparecchio, e proteggendo l’apertura dell’apparecchio con l’utilizzo di lucchetti di sicurezza o contenitori antifurto e came lock (lucchetti a cavo antifurto).
