from the day on which the notification of the withdrawal of this contract by the buyer is received by the seller. For this refund, the seller uses the same payment method that the buyer used in the original transaction, unless expressly agreed otherwise with the buyer; in no case will the buyer be charged fees for this refund. The seller may refuse the refund until they have received the goods back or until the buyer has provided proof that they have sent the goods back, whichever is earlier. The buyer must return or hand over the goods to the seller immediately and in any case no later than fourteen days from the day they inform the seller about the withdrawal of this contract. The deadline is met if the buyer sends the goods before the expiry of the fourteen-day period. The buyer bears the direct costs of returning the goods. The buyer is only liable for any loss in value of the goods if this loss in value is due to handling the goods beyond what is necessary to check their condition, properties, and functioning. § 4 Prices, Price Changes The prices are understood as cash prices including statutory VAT plus a flat rate for shipping and packaging. For packaging, postage, and delivery, we charge a flat rate of €7.50 for delivery via DHL/DPD within Germany for a delivery weight up to 5 kg. For heavier shipments and/or shipping abroad, the shipping cost share is at least €25. Weapons and ammunition shipping is carried out only by weapons courier due to legal requirements, within Germany for €48.50. The weapon may only be received by the actual authorized recipient and will only be handed over to them. The authorization must be proven to the courier by photo ID. Unless expressly agreed otherwise, we determine the appropriate shipping method and the transport company at our reasonable discretion. If the customer is a consumer, the risk of accidental loss, accidental damage, or accidental destruction of the delivered goods passes to the customer at the time the goods are delivered to the customer or the customer is in default of acceptance. In all other cases, the risk passes to the customer upon delivery of the goods to the transport company. If more than 6 months elapse between the conclusion of the contract and the agreed and/or actual delivery date, the prices valid at the time of delivery or provision by the seller apply. If these latter prices exceed the initially agreed prices by more than 10%, the buyer is entitled to withdraw from the contract. § 5 Delivery The seller undertakes, after conclusion of the purchase contract and full payment of the purchase price, to send the goods immediately to the buyer by post or freight forwarding and/or certified weapons shipping. Partial deliveries are permitted as long as they are reasonable for the buyer. If the goods are not or not timely deliverable, for example because one of our suppliers does not deliver the goods on time, we will notify the customer immediately. If the goods are not available from our suppliers for a foreseeable period, we are entitled to withdraw from the purchase contract. In the event of withdrawal, we will refund the customer’s payments to us immediately. The seller bears the necessary expenses for subsequent performance. The permissibility of the choice results from the consideration of proportionality. If the subsequent performance is unsuccessful, the buyer can withdraw from the contract or reduce the purchase price or claim damages or reimbursement of futile expenses according to the statutory provisions. The warranty period is 2 years and begins with the delivery of the item. If the delivery item is a used item, the warranty period is 12 months from the time of delivery. Claims for damages resulting from injury to life, body, and health as well as for damages based on intentional or grossly negligent breach of duty remain unaffected by the above limitation of the statute of limitations. § 7 Liability The company General Security GmbH is liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, according to the provisions of the Product Liability Act, as well as within the scope of any guarantee assumed by us. Notwithstanding the regulation in sentence 1, we are only liable for negligence in the case of breach of essential contractual obligations, i.e., the breach of obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies ("cardinal obligation"). In the case of a slightly negligent breach of a cardinal obligation, liability is limited to typical damages and/or a typical scope of damage that were foreseeable at the time of contract conclusion.
