1. Purchase on Approval
At Stöcker Waffen und Munition, you buy on approval, meaning you can return delivered goods without giving reasons within 14 days of receiving the goods. The purchase contract becomes binding upon your approval after receipt of the goods. Approval is deemed to have occurred if you do not send us a cancellation statement or return the delivered goods within the 14-day approval period. After approval, you also have the statutory right of withdrawal.

2. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, has taken possession of the last goods. However, the period does not begin until the purchase contract has become binding for you through your approval of the purchased item.

To exercise your right of withdrawal, you must inform us (Stöcker Waffen und Munition, Mangersreuther Str.18a 95326 Kulmbach) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached sample withdrawal form for this purpose.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return the goods immediately and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract, to us or hand them over to DHL or Overnite. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the costs of returning the goods.

You only have to pay for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for checking their nature, characteristics, and functioning.

3. Exclusion/Expiration of the Right of Withdrawal

The right of withdrawal does not exist according to § 312g Abs. 2 BGB, among other things, for contracts for the delivery of goods that are not prefabricated and for whose production an individual choice or specification by the consumer is significant or which are clearly tailored to the personal needs of the consumer, and it expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for health or hygiene reasons if their seal has been removed after delivery.

4. Flat Rate Shipping Costs (for postage and packaging)
For each order and delivery address, a shipping flat rate of €6 is charged for items with parcel delivery, regardless of the order value. For separately marked items that are delivered by freight due to their bulkiness or weight (freight items), the shipping costs are indicated on the item. When ordering items with parcel and freight delivery at the same time, we only charge the higher shipping costs per delivery address.

5. Shipping Costs for Weapons, Weapon Parts, and Ammunition
For all weapons, weapon parts, and ammunition that require a purchase permit, hazardous goods shipments, and items for individuals over 18 years of age, the following applies:

(personal handover to the purchaser is only possible upon presentation of a valid ID): Postage & packaging: up to 5kg €35, up to 10kg €45, up to 20kg €55, up to 30kg €65.

Surcharges will not be refunded to the customer account in the event of the return of surchargeable items and must be settled.

For items with a length or width greater than 1.20 m, a surcharge of €27 is due: Postage & packaging: €6; total €33.

6. Warranty and Liability

The buyer's claims for defects expire for new goods after two years, for used goods after one year from delivery, unless the seller, his legal representatives, or his vicarious agents have fraudulently concealed the defect or have assumed a guarantee for the quality of the goods. If a seller's guarantee is granted, the details are derived from the independent guarantee conditions attached to the respective delivered item. Warranty claims exist independently of and in addition to the statutory claims and rights. The seller is fully liable according to the statutory provisions for damages to life, body, and health that are based on a negligent or intentional breach of duty by him, his legal representatives, or his vicarious agents, as well as for damages covered by the Product Liability Act, and for all damages that are based on intentional or grossly negligent breaches of contract as well as fraud by the seller, his legal representatives, or his vicarious agents. If the seller has provided a quality and/or durability guarantee regarding the subject matter of the contract or parts thereof, he is also liable within the framework of this guarantee. The seller is also liable if the buyer has claims for damages instead of performance. However, the seller is only liable to the extent that the damages are typically associated with the contract and foreseeable.

7. Acquisition of Weapons, Ammunition, Powder
Weapons and ammunition requiring a purchase permit will only be delivered upon presentation of the necessary official documents (e.g., weapon permit, acquisition authorization, hunting license, etc.) in original or as a photocopy of all labeled pages. This does not apply to the firearms ownership card, the ammunition acquisition permit, or any special permits. These must always be submitted in original. Items that do not require a purchase permit (e.g., air guns up to 7.5 joules, single-shot black powder guns, sabers, bayonets, etc.) will only be delivered upon presentation of an official photo ID or a photocopy of all labeled pages from which it is evident that the purchaser has reached the age of 18. Powder can only be purchased in the store upon presentation of the explosives permit in original. The regulations of the Weapons Act remain unaffected.

8. Validity of Prices
The prices stated on [● Domain Online-Shop im Aufbau] are online prices in EUR and include the statutory VAT.

9. Payment Options, Due Date, and Default
You can pay for the order by credit card, advance payment, cash on delivery (plus €5 fee), RatePay, SEPA direct debit mandate, or on account. There is no possibility for a discount. We reserve the right to offer you only certain payment methods for the requested delivery, for example, to secure a credit risk only those according to the respective creditworthiness. In individual cases, we reserve the right to deliver the goods only after a deposit. After receipt of the order, we will coordinate this with the customer. Payment is due immediately upon receipt of the invoice. The buyer automatically falls into default without a reminder if he does not pay the purchase price within 30 days after receipt of the goods.

10. Set-off
The buyer may only offset against the purchase price claim with undisputed, legally established, or such claims that have arisen from a justified refusal of performance.

10. Retention of Title
The goods remain the property of the seller until full payment of the purchase price has been made. The buyer must inform the seller immediately if measures by third parties – especially seizures – or other events jeopardize the rights of the seller. Furthermore, the buyer must point out the seller's ownership in the event of a seizure.

The place of fulfillment is Kulmbach.

There are no oral side agreements. The proof of the contrary is permitted.

You agree that contract-related communication may take place in electronic form.

12. Alternative Dispute Resolution
We are not obliged and not willing to participate in dispute resolution procedures before a consumer arbitration board.

10. Legal Consequences of Invalid Provisions
Should individual provisions be wholly or partially invalid or unenforceable, the validity of the remaining provisions of this contract shall not be affected. The contracting parties will replace the invalid or unenforceable provision with a provision that comes closest to the meaning and purpose of the invalid or unenforceable provision.
