The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of the seller's information obligations according to Article 246 § 2 EGBGB in conjunction with § 1 Abs. 1 and 2 EGBGB as well as his obligations according to § 312g Abs. 1 Satz 1 BGB in conjunction with Article 246 § 3 EGBGB. Withdrawal consequences
In the event of a valid withdrawal, the performances received by both parties must be returned and surrendered. If the buyer cannot return the received performance as well as benefits (e.g. usage advantages) in whole or in part or only in a deteriorated condition, he must provide the seller with compensation in this respect. For the deterioration of the item and for benefits drawn, the buyer must only provide compensation to the extent that the benefits or the deterioration are attributable to handling of the item that goes beyond the examination of the properties and the functionality. "Examination of the properties and the functionality" means testing and trying out the respective goods as it is possible and customary in a retail store. Items that can be shipped in a package are to be returned at the seller's expense and risk. Non-packageable items will be picked up from the buyer. Obligations to refund payments must be fulfilled within 30 days. The period begins for the buyer with the sending of his withdrawal declaration or the item, for the seller with their receipt.
